ORDER IMPOSING CIVIL MONETARY PENALTY - $75,000 PALO VERDE NUCLEAR GENERATING STATION (PVNGS)
UNITS 1, 2, AND 3 This refers to your letter dated October 25, 1990 in response to the Notice of Violation and Proposed Imposition of Civil Penalty (Notice) sent to you by our letter dated September 26, 1990.
Our letter and Notice describe two violations identified by an NRC inspection.
To emphasize the importance of ensuring that all licensed operators are medically qualified, that such determinations are timely and properly docu-
- mented, and that any discrepancies are aggressively and thoroughly pursued, a
civil penalty of $75,000 was proposed.
In your response, you admit that the violations occurred as stated in the Notice, but request that the NRC reconsider the amount of the proposed civil penalty based on your belief that all relevant facts may not have been considered in weighing the escalation and mitigation factors.
After consideration of your response, we have concluded, for the reasons given in the Appendix attached to the enclosed Order Imposing Civil Monetary Penalty, that the violations occurred as stated and that the proposed civil penalty is appropriate.
Accordingly, we,hereby serve the enclosed Order on Arizona Public Service Company imposing a civil monetary penalty in the amount of $75,000.
We wi 11 review the effectiveness of your corrective actions during a future inspection.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice",
a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
