PROPOSED IMPOSITION OF CIVIL PENALTY - 125,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $ 125,000 will be issued on or about October 16, 1990 to Arizona Public Service.
This action is based on the failure to,ensure the adequacy of the emergency lighting system.
gA Program require-ments for Test. Control and Corrective Action were not applied to portions of the fire protection system.
In addition, various emergency lighting units in the Control Room, Control Building, and Auxiliary Building were not capable of operating for the specified eight hours.
The civil penalty was escalated 50K for NRC identification and 100K for poor past performance with emergency lighting.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:
Hailing of Notice Telephone Notification of Licensee The State of Arizona will be notified.
October 16, '1990 October 16, 1990 The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
