90-056-026; 90-001-028.6 Enclosed for your information is a copy. of a recent complaint filed by the Arizona Corporation Commission (ACC) with the U. S. Securities and Exchange Commission (SEC) seeking revocation or modirication of the exemption of Pinnacle West Capital Corporation (Pinnacle), the corporate parent of Arizona Public Service Company (APS),
from the Public UtilityHolding Company Act (PUHCA).
APS, as you are aware, is.the operating licensee of the Palo Verde Nuclear Generating Station (PVNGS). -Because the complaint makes certain assertions regarding the operation of PVNGS, based in substantial part on extracts from the NRC's recent diagnostic evaluation report (see.pp. 31-34),.we are transmitting the document for your information.
The complaint is wholly without merit.
To the extent that it suggests that safety at PVNGS may be comprised by the financial difficulties which have been encountered hy Pinnacle, it is plainly at variance with the NRC's diagnostic evaluation report which concludes:
... the team found no evidence that financial difficulties at Pinnacle West or APS appropriation levels had jeopardized safety systems or the safe operation of the units.
Interviews and documents revealed that the resources (money,
- people, equipment, materials, and facilities) provided to Palo Verde by APS were generally adequate to meet needs.
There had been significant overruns in past Operations and Maintenance (08aM) budgets.
Senior management at both the site and corporate offices indicated a strong commitment of resources to operate the plant safely and reliably.
