Subject:
PROPOSED IMPOSITIO!J OF CIVIL PENALTY - $250,000 QCJ This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of Two Hundred Fifty Thousand Dollars
($250,000) will be issued on or about September 1989 to Arizona Nuclear Power Project.
This action is based on violations identified by an AIT investigation of the March 3, 1989 Unit 3 reactor trip, safety injection and loss of rior-class IE electrical power.
The violations were grouped into three Severity Level III problems.
The first addressed inadequate corrective actions and dealt mainly with the atmospheric dump valves.
The base civil penalty was escalated 100%
for the added significance resulting from the duration of these violations.
The second problem concerned operator and training issues for which no escalation or mitigation is appropriate.
The third problem was inadequate emergency lighting and the civil penialty was escalated 100
- 50% escalation because the NRC identified the violations, 100% escalation for the duration of the installation, testing and maintenance violations, and 50% mitigation because the corrective actions were extensive.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification is:

1989 Telephone Notification of Licensee September 1,
1989 The State of Arizona will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civi 1 penalty may be remitted, mitigated, or imposed by Order.
