This is to inform the 'Commission that two 'Notices Of 'Violation'nd

'Proposed'mposition of Civil Penalty in the amounts of Fifty Thousand Dollars ($50,000) and Two Hundred Thousand Dollars ($200,000) respectively will be issued on or about December 1,

1988 to Arizona Nuclear Power Project.

These actions are based on problems in the areas of plant operations and radiological controls.

In plant,.operations a civil penalty is proposed,for'an..event.

in;.which both trains of the essential chilled water system were rendered inoperable.

In the area of radiological controls two separate civil penalties are proposed.

One of the civil penalties is proposed for an event which resulted in an individual receiving a cumulative whole body radiation dose in excess of the limits of 10 CFR Part 20 and significant deficiencies in the licensee's ALARA program and the other is proposed for a breakdown in the licensee's control of high radiation areas.

The escalation and mitigation factors of the Enforcement Policy were considered and for the civil penalty in the area of plant operations no adjustment to the base civil penalty was deemed appropriate.

For the two civil penalties proposed in the area of radiological controls, escalation of each penalty by. 100>> was deemed appropriate because of th6 licensee's'prior notice of these type problems and the multiple examples of many of the violations.

Due to a meeting of the Regional Administrator with the licensee on December 1,

1988, we are providing a shorter than normal Commission notification period.

It should be noted that the licensee has not been specifically informed of the enforcement action.

The schedule of issuance and notification is:

Mailing of,Notice December 1,

1988 Telephone Notification of Licensee December 1,

1988 The State of Arizona will be notified.

The licensee has thirty days from the date of the Notice in which to respond.

Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
