PALO VERDE NUCLEAR GENERATING STATION, UNITNOS. 1, 2, AND3-ISSUANCE OF EXEMPTION FROM CERTAIN REQUIREMENTS OF 10 CFR 50.71(e)(4) (TAC NOS. MA2159, MA2160, AND MA2161)
Dear Mr. Levine:
The Commission has issued the enclosed exemption fro'm certain requirements of 10 CFR 50.71(e)(4) for the Palo Verde Nuclear Generating Station (Palo Verde) Unit Nos. 1, 2, and 3.
This exemption is related to your application dated June 9, 1998, as supplemented by your letter dated December 21, 1998.
In these letters, Arizona Public Service Company (APS) requested approval to submit to the Commission, on a 24-month periodicity, revisions to the Updated Final Safety Analysis Report, changes to the quality assurance program made in accordance with 10 CFR 50.54(a)(3), and reports of changes, tests, and experiments made in accordance with 10 CFR 50.59(b)(2).
The updates would not be tied to a particular unit's refueling outage schedule.
A copy of the exemption and the staffs safety evaluation are enclosed.
The exemption is being forwarded to the Office of the Federal Register for publication.
APS also requested that this exemption apply to the reports of changes to the Technical Specification (TS) Bases made in accordance with Section 5.5.14d of the Palo Verde TSs. The staff has concluded that the exemption process is not the appropriate regulatory vehicle for making this change.
Instead, APS should request an amendment to the Palo Verde TSs in accordance with 10 CFR 50.90 to modify the reporting frequency of changes made to the TS Bases.
