'PALO VERDE NUCLEAR GENERATING STATION UNI'T 3; ANTITRUST OPERATING LICENSE REVIEW; DOCKET 50-530A; SETTLEMENT AGREEMENT In its antitrust operating license review of the captioned nuclear unit, staff uncovered several areas of competitive concern pursuant to El Paso Electric Company's (co-licensee) policies regarding transmission access in the desert Southwest.
El Paso's practices primarily affected'he Plains -Electric Genera-tion and Transmission Cooperative, Inc. and Plains'bility to effectively compete in the Southwestern bulk power services market.
Since.op note to you of, April 21, 1987 concerning the status of this proceeding, the parties (Plains and El Paso) have entered into an agreement (attached) resolving the issues of concern to Plains and the staff.
Consequently,. Plains has requested that its outstanding request to. conduct a hearing
.in this proceed-ing be withdrawn.
Staff, at this time, does not anticipate that the antitrust review of Palo Verde 3 will impact upon the licensing of the unit.
