Dear Mr. Knighton:
The attachment to this letter is a justification for interim operation of the emergency lighting system until initial criticality.
Due to the emergency lighting batteries failing the 8 hour9.259259e-5 days <br />0.00222 hours <br />1.322751e-5 weeks <br />3.044e-6 months <br /> test, emergency lighting will not be fully operable prior to fuel load.
New batteries will be procurred, installed and tested prior to initial criticality.
Since emergency lighting required for safe shutdown is part of the fixe protection program as described in FSAR Section 9B, this takes exception to the PVNGS commitment to have the fire protection program in place prior to fuel load.

Prior to initial criticality, the batteries are not needed for safe shutdown since the reactor is already in a shut down configuration.
As a compensatory
- measure, flashlights are already available in the control room for emergency use.
