IN RESPONSE REFER TO FOIA-83-450 This is in further response to a letter from Ms.

Lynne Bernabei dated August 5, 1983, in which she requested agency records relating to allegations made by Rober t Gunderson and Wallace Royce concerning the Palo Verde Nuclear Generating Station.

The document listed below is subject to your request:

Johnson, "Proposed Enforcement Action Related to False Information Contained in Records of Electrical Terminations at Palo Verde Unit No.

The document is a draft containing advice, opinions, and recommendations of the staff with respect to a proposed enforcement action.

Releasing this document would interfere with enforcement proceedings.

This document is being withheld in its entirety from public disclosure pursuant to Exemptions (5) and (7)(A) of the Freedom of Information Act (5 U.S.C. 552(b)(5) and (7)(A)) and 10 CFR 9.5(a)(5) and (7)(i) of the Commission's regulations.

1983 The denial by Mr. Martin and myself may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.

As provided in 10 CFR 9. 11, any such appeal must be in writing addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an "Appeal from an Initial FOIA Decision."

The search and review of additional documents subject to your request is continuing.

When our review is completed, you will be notified of our determination.
