By letter dated September 23, 1901,-.; as revised by letter dated Deceriber 31,
- 1981, the Arizona Public Service GorIpany submitted, at the request of the NRC staff, structural calculations performed by the Bechtel Power Corporation for various buildings and structures in the Palo Verde Nuclear Generating Station,- Units 1, 2 and 3.
Sy letter dated December 30, 1901, the Arizona Public Service Company submitted additional calculations performed by Bechtel for the Palo Yerde cable tray design.
The Septenber 23, 1981 and Decenber 30, 1981 letters included your 'affidavits dated Septeinber 72, 1981 and Dccerrber Iir, 1981, respectively, which requested that, the submitted fnfomatfon be with-held fran public dfsclosure pursuant to 10 CFR 2.790.
Yau stated that the subnftted information should be considered exempt fran mandatory public disclasure for the following reasons:
1.
The information has been held fn confidence by Bechtel Power Corporation.
The information fs of a type customarily held in confidence by Bechtel Power Corporation.
3.
The information is not available in public sources.
4.
Public disclosure of the fnfornatfon is likely to cause substantial harn to the competitive position of Bechtel Power Corporation for the following reasons:
a)
The fnforr~ation is valuable to Bechtel Power Corporatian because it represents unique approaches and capabilities for resolving conplex safety, technical, cornercfal and industry factors to comply with applicable laws, statutes and regulations.
b)
Substantial and significant effort and nancy has been and is being, expended by Bechtel Power Corporation to develop, acquire and maintain the necessarv exner tise and eanahilffv in the~n hinhl spe fa1ized area..

Others would have difficulty in properly acquiring or duplicating the information which represents special applications of theoretical principles, complex analytical procedures and sophisticated design techniques.
We have reviewed your applications and the material based on the requirements and criteria of 10 CFR 2.790 and, on the basis of Bechtel Power Corporation's statements, have determined that the submitted information sought to be with-held contains trade secrets or proprietary commerical information.
It is our belief, pursuant to 10 CFR 2.790 (b) (5) and Section 103(b) of the Atomic Energy Act of 1954, as
- amended, that, at this time, the right of the public to be full apprised of the submitted information does not outweigh the need to protect Bechtel Power Corporation's competitive position.
Accordingly, we have determined that the information should be withheld from public disclosure.
We, therefore, approve your request for withholding pursuant to 10 CFR 2.790 and are withholding the calculations of the Palo Verde buildings and structures, submitted by the Arizona Public Service Company by letters dated September 23,
- 1981, December 30, 1981 and December 31, 1981, from public inspection as proprietary.
Withholding from public inspection shall not affect the.right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of this information to our consultants working in this area.
Wo will, of course, insure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the HRC.
You should also understand that the HRC nay have cause toreview this determination in the
- future, such as if the scope of a Freedom of Information Act request includes'our information.
In all review situations, if the HRC needs additional information from you or makes a determination adverse to the above, you will be notified in advance of any public disclosure.
