. SUBJECT:
NRC INSPECTION REPORT 50-397/97-20, NOTICE OF VIOLATION,AND
EXERCISE OF ENFORCEMENT DISCRETION
Dear Mr. Parrish:
An NRC inspection was conducted December 21, 1997, through January 31, 1998, at your
Washington Nuclear Project-2 reactor facility. The enclosed report presents the scope and
results of that inspection.
During the inspection period the conduct of licensed activities was characterized
by safety-
conscious operations and generally good maintenance practices.
However, one violation of
NRC requirements was identified for failure to properly label radioactive material containers and
is similar to previous events which have been identified by your personnel.
The violation is cited in the enclosed Notice of Violation (Notice) and the circumstances
surrounding this violation are described in detail in the enclosed report.
Please note that you are
required to respond to this letter and should followthe instructions specified in the enclosed
Notice when preparing your response.
The NRC will use your response,
in part, to determine
whether further enforcement action is necessary to ensure compliance with regulatory
requirements.
A violation was also identified for three examples where your staff failed to update the facility's
Final Safety Analysis Report (FSAR) when changes to the facilitywere made in accordance with
10 CFR 50.59. This violation would be classified at Severity Level IV and normally would be
cited because it was identified by the NRC. However, after consultation with the NRC's Office of
Enforcement, the NRC is exercising discretion in accordance with Section VII.B.3of the
Enforcement Policy and is not taking formal enforcement action.
Specifically, the NRC
recognizes that you have underway a comprehensive
program to review and update your FSAR.
This program was described in your letters dated February 7 and June 6, 1997, and also in NRC
Inspection Report 50-39?/97-14.
It is the NRC's view, given the scope and schedule for
completing this review, that this violation likely would have been identified through your FSAR
review program.
In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter, its
enclosures,
and your response will be placed in the NRC Public Document Room (PDR). To the
extent possible, your response should not include any personal privacy, proprietary, or
safeguards
information so that it can be placed in the PDR without redaction.
