IHPOSITIOM OF CIVIL PENALTY -
$100,000 By EN 96-084 dated November 21, 1996, the Commission was notified of the intent of OE to issue a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 to Washington Public Power Supply System.
The action was based on several instances in which required surveillances were not performed.
In some cases, mode changes were made without assurance that required equipment was operable, and in one case, a mode change was made with one train of the control room emergency filtration system inoperable.
The violations were collectively characterized as a Severity Level III problem.
Although credit was warranted for both the factors of identification and corrective action, the root causes of the violations were similar to previous violations that were part of a Severity Level III problem and proposed
$50.000 civil penalty issued in August 1995 (EA 9F 096).
Thus, to emphasize the failure of the licensee's previous corrective actions to preclude similar violations from occurring, and to emphasize the fundamental importance of having an effective program for assuring that survei llances are performed as
- required, the staff exercised discretion under VII.A.1 of the Enforcement Policy and proposed a
$100,000 civil penalty.
The licensee responded to the Notice in a letter dated December 23.
1996.
In that letter the licensee admitted the violations, but requested reconsideration of the penalty.
After careful consideration of the licensee's
- response, the staft has concluded that the licensee did not provide an adequate basis for mitigation of the civil penalty.
Accordingly, an Order Imposing Civil Honetary Penalty in the amount of
$100.000 has been issued today.
Under the terms'f the Order, the licensee may within 30 days of the.date of the Orders pay the civi 1 penalty or request a hearing.
