NRC INSPECTION REPORT 50-397/96-16AND REVISED NOTICE OF

VIOLATION

Dear Mr. Parrish:

Thank you for your letters (G02-96-197 and G02-96-208) of October 14 and 28, 1996, in

response to our inspection report and Notice of Violation dated September

12, 1996,

concerning two violations related to an error in data entry into the control room log and

incorrect strip chart paper installed in a source range recorder.

Both violations were

incident to other activities related to the manipulation of reactivity controls which were the

discussion of a predecisional enforcement conference conducted on October 22, 1996, in

the NRC Region IV office. However, at the conference we questioned your basis for the

denial and you subsequently modified your position by letter dated October 28, 1996.

We have reviewed your replies and the additional information you provided in the letter

dated November 1, 1996.

We disagree with certain conclusions the Supply System

reached with respect to concerns raised in the Notice of Violation dated September

12,

1996. Specifically, we do not agree that the violations should be characterized

as "minor."

First, both violations were associated with the early criticality event.

Secondly, if the

violations recurred, we would have

a more significant concern with respect to control room

activities and administrative recordkeeping.

Therefore, the issues

are considered of more

than minor significance.

In your response to NRC Violation 50-397/9616-02,

which the Supply System denied, you

indicated that the use of linear strip chart paper as an alternative method when no

logarithmic paper is available is an acceptable practice.

However, in this instance

logarithmic strip paper was available.

Further, we know of no procedural guidance to

ensure that the record is annoted as to its proper logarithmic scale for future identification.

Therefore, we believe this is a valid violation.

Because both concerns

are examples of inadequate

administrative recordkeeping,

the two

violations are being combined into one violation with two examples.

Also, because

these

violations were identified by the NRC, they are not eligible for treatment as noncited

violations.

Therefore, the original Notice of Violation is hereby withdrawn. A revised

Severity Level IV violation is being issued herewith and is described

in the enclosed Notice

of Violation.

At the conference, your staff noted that, although there were questions regarding the

regulatory disposition, the supply system believed the issues were valid and needed

corrective action.

As such, your staff took the appropriate steps to ensure these violations

do not recur.

The NRC has concluded that information regarding the reason for the

violation, the corrective action taken and planned to correct the violation and prevent

r currence and the date when full compliance was achieved is already adequately

addressed

on the docket in your responses

to NRC Inspection Report No. 50-397/96-16

dated October 14, and 28, 1996, and the additional information you submitted on

November 1, 1996. Therefore, you are not required to respond to this letter unless the

description therein does not accurately reflect your corrective actions or your position.

In

that case, or if you choose to provide additional information, you should follow the

instructions specified in the enclosed Notice.

We willreview the implementation of your corrective actions during a future inspection to

determine that full compliance has been achieved and will be maintained.
