This refers to the special

inspection

conducted

by Hr.

R. C. Barr,

and the

inspectors

identified in the enclosed report, of this office on Harch

28

through

Hay 7,

1994.

The inspection

included review of activities authorized

for your WNP-2 facility.

At the conclusion of the inspection,

on Hay 13,

1994,

the findings were discussed

with you and those

members of your staff

identified in the enclosed report.

Areas

examined during this inspection

are described

in the enclosed

inspection

report.

This special

inspection

examined

the supply system's

evaluation

and

corrective actions

associated

with the failure of Control Rod 06-39 to insert,

while your operators

were conducting control rod surveillance testing

on

Harch 26,

1994.

The inspection consisted of selective

examinations of

procedures

and representative

records,

interviews with personnel,

and

observations

by the inspectors.

The purpose of the inspection

was to

determine whether activities authorized

by the license

were conducted

safely

and in accordance

with NRC requirements.

Based

on the results of this inspection,

two apparent violations were

identified and are being considered for escalated

enforcement

action in

accordance

with the "General

Statement

of Policy and Procedure for NRC

Enforcement Actions" (Enforcement Policy),

10 CFR Part 2, Appendix

C (1994).

Accordingly, no Notice of Violation is presently

being issued for these

inspection findings.

Please

be advised that the number

and characterization

of the apparent violations described

in the enclosed

inspection report

may

change

as

a result of further

NRC review.

The apparent violations involved:

(1) the failure to take prompt corrective

action to prevent degradation

of the

WNP-2 reactivity control

system

and

(2) the failure to perform prompt operability assessments

upon finding

physical

evidence of degraded

safety related

equipment.

Specifically,

scram

solenoid pilot valves of selected

control rods

have failed to operate

as

designed,

due to degraded

Buna-N components

(diaphragms).

The supply system's

failure to take prompt corrective action for these failures

has resulted

in

WNP-2 unknowingly operating in violation of Technical Specification 3. 1.3.4

and having

a control rod that failed to inser t during subsequent

testing.

We

're

especially

concerned

because

significant industry information had

been

distributed to alert you to the potential for degradation of Buna-N components

in these valves.

The failure of these

valves to function as designed

appears

to be another

example

where the supply system

has not responded

conservatively

to industry experience.

In addition, this situation indicates that conditions

of less

than adequate

interface

between engineering

and operations,

and of

failure to follow procedures,

continue to exist.

An enforcement

conference

to discuss

these

apparent violations will be

scheduled

on

a mutually agreeable

date in the Region

IV office in Arlington,

Texas.

The decision to hold an enforcement

conference

does,not

mean that the

NRC has determined that

a violation has occurred or that enforcement

action

will be taken.

The purposes

of this conference

are to discuss

the apparent

violations, their causes

and safety significance;

to provide you the

opportunity to point out any errors in our inspection report;

and to provide

an opportunity for you to present your proposed corrective 'actions.

In

addition, this is

an opportunity for you to provide any information concerning

your perspectives

on:

(I) the severity of the violations,

(2) the application

of the factors that the

NRC considers

when it determines

the amount of a civil

penalty that

may be assessed

in accordance

with Section VI.B.2 of the

Enforcement Policy,

and (3) any other application of the Enforcement Policy to

this case,

including the exercise of discretion in accordance

with

Section VII.

You will be advised

by separate

correspondence

of the results of

our deliberations after completion of the enforcement

conference.

No response

regarding

these

apparent violations is required at this time.

In accordance

with 10 CFR 2.790 of the NRC's "Rules of Practice,"

a copy of

this letter and the enclosure will be placed in the

NRC Public Document

Room.
