CLARIFICATION OF REPORTING OBLIGATIONS UNDER 50.72 (TAC NO. H86815)

Your letter dated June 15,

1993, requested confirmation of, or formal relief from, the 4-hour notification requirement contained in 10 CFR 50.72(b)(2)(vi) for situations in which the Supply System provides reports of certain minimum levels of radioactivity to the State of Washington.

The Supply System is currently providing 4-hour reports to the NRC for low levels of radioactivity, described by the State of Washington and the Supply System as exceeding ambient environmental levels but below NRC regulatory limits, that the Supply System has agreed to report to the State of Washington.

The Supply System contends that the notification requirements of 10 CFR 50.72(b)(2)(vi) were not intended to require reporting of these low-level releases.

In support of this position, the Supply System cites Supplement 1 to NUREG-1022, dated February

1984, and a draft revision to NUREG-1022 that has been issued by the NRC staff for public comment.

The staff has not previously provided guidance on the reportability of licensee reports to state agencies regarding low-level radiological releases.

As the Supply System notes,

however, the staff has proposed in the draft revision to NUREG-1022 that required state reports of minor radiological releases need not be reported pursuant to 10 CFR 50.72(b)(2)(vi).

Until a final revision to NUREG-1022 is issued, the staff's interim position is that such state reports need not be reported to the NRC under 10 CFR 50.72(b)(2)(vi).

However, when the final revision to NUREG-1022 is published, the Supply System should verify the staff's final position, and determine 9309140391 930902 PDR ADOCK 05000397 P
