NOTICE OF VIOLATION Washington Public Power Supply. System Post Office Box 968

Richland, h'A 99352 Docket No. 50-397 License No.

NPF-21 During an NRC inspection conducted on September 18 - October 22,

1991, a

violation of NRC requirements was identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions,"

10 CFR Part P.,

Appendix C (1991), the violation is listed below:

Section 6.8. 1 of the Technical Specifications

states, in part: "k'ritten procedures shall be established, implemented, and maintained covering the activities referenced below:

The applicable procedures recommended in Appendix A of Regulatory, Guide 1.33, Revision 2, February 1978."

Regulatory Guide 1.33, Revision 2, February 1978, Appendix A, includes the following among safety-related activities for which procedures are recommended:

"2.

General Operating Procedures "a.

Cold Shutdown to Hot Standby "b.

Hot Standby to Minimum Load (nuclear startup)"

Plant Procedures manual (PPY) 3.1.2, Revision 20, "Reactor Plant Cold Startup,"

paragraph 4.21 stated:

"YS-V-16, MS-V-19, and YiS-V-67A, 8, C,

D shall be closed whenever reactor power is GE [greater than or equal tol 5% to prevent potential iodine release during accident, conditions.

These valves shall remain closed until the Reactor is in Mode 4, unless either of the following exceptions are in effect:

Directed otherwise by Emergency Operating Procedur'es.

These valves are required to be opened to equalize pressure across the MSIV's following a scram."

Contrary to the above, on September 29, 1991 during plant startup from

. Mode 4, YiS-V-16 and Y'S-V-19 were closed before exceeding a power level in excess of 5% and later after reducing power below 5% the valves were reopened with the reactor still in Mode 2 (Startup/Hot Standby),

and with neither of the stated exceptions in effect.

This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Mashington Public Power Supply System is hereby required to submit a written statement or explanation to the U.

S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region V, and a copy to the NRC Resident Inspector,'ithin 30 days of the date of the letter trans-mitting=thiss Notice.

(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will'e achieved, If an adeouate reply is not received within the time specified in this Notice, the Commission may issue an order or a demand for information as to why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.

Where good cause is shown, consideration will be given to extending the response time.
