NOTICE OF VIOLATION Washington Public Power Supply System (Supply System)
Nuclear Project No.
2 (WNP-2)
Docket No. 50-397 License No.
NPF-21 During an NRC inspection conducted on February 25 through March 1, 1991, two violations of NRC requirements were identified.
In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C (1991), the violations are listed below A.
10 CFR Part 20.311(d) states in part that any licensee who transfers radioactive waste to a land disposal facility shall: "(1) Prepare all waste so that the waste is classified according to 561.55 and meets the Waste characteristics requirements in 561.56 of this chapter".
Contrary to the above, on January 30, 1991, licensee shipment'(No.
91-05-02) of dewatered radioactive resins received at a licensed radioactive waste disposal facility was misclassified as meeting the stabilization criteria for Class B wastes (10 CFR Part 61.55 and 61.56).
This is a Severity Level IV Violation (Supplement IV)

Due to the comprehensiveness of the planned corrective actions and commitments made to the 'State of Washington'no response to this violation is required.

10 CFR Part 71. 12(c)(3),
"General License:
NRC approved package,"
- requires, in part, that "This general license applies only to a licensee who:
Submits in writing to the Director, Office of Nuclear Material safety and Safeguards, U.S. Nuclear Regulatory Commission,... prior to the licensee's first use of the package, the licensee's name and license number and the package identification number specified in.the package approval."
Contrary to the above, on August 6, 1990, the licensee used NRC certified
- package, Model No.: 10-142, Certificate No.
9208 LUSA/9208/B( )), serial No'. 97382, to transport radioactive waste in quantities greater than Type A, without first registering as a user with the NRC.
The licensee shipped radioactive waste in this package on six other occasions during the year 1990

Pursuant to the provisions of 10 CFR 2.201, Washington Public Power Supply System is hereby required to submit a written statement or explanation in response to Item B to the U.S. Nuclear Regulatory Commission, ATTN:
Document Control Desk, Washington, D.C.
20555 with a copy to the Regional Administrator, Region V, and, a copy to the

Inspector, within 30 days of the date of the letter transmitting this Notice, of Violation (Notice).
This reply should be clearly marked as a "Reply to a Noti'ce of Violation" and should include for the violation:
(1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective. steps that have been taken and the results
- achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended-,
or revoked, or why such other action as may be proper should not be taken.
Where good cause is shown, consideration will be given to extending the response time.
