APPENDIX A NOTICE OF VIOLATION Washington Public Power Supply System Washington Nuclear Project Unit 2 Docket No. 50-397 License No.

NPF-21 During an NRC inspection conducted on July 10-14,

1989, two violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, (1988),

as modified by 53 Fed. Reg. 40019 (October 13, 1988), the violations are listed below:

A.

Technical Specification 6.5.2, Cor orate Nuclear Safet Review Board, states in part:

"Audits of unit activities shall be performed under the cognizance of the CNSRB

These audits shall encompass:

"b.

The performance, training and qualifications of the entire unit staff at least once per 12 months."

Contrary to the above, as of July 10,

1989, an audit of the performance, training and qualifications of the entire unit staff had not been conducted for a period of 21 months, in that Equipment Operators were specifically excluded as part of the regularly scheduled audit of 1988, having been last reported as audited on October 9, 1987.

This is a Severity Level IV violation (Supplement VII).

B. '0 CFR 71.5, Trans ortation of licensed materials, states in part:

"(a) Each licensee...who delivers licensed material to a carrier for transport...shall comply with...49 CFR Parts 170 through 189."

49 CFR 173.425(b) states, in part:

"Packaged shipments of LSA material consigned as exclusive use shall.:.comply with the following:

(1) Materials must be packaged in strong, tight packages so that there will be no leakage of radioactive material under conditions normally incident to transportation."

Contrary to the above, on June 13, 1989, shipment number 89-32-02, an exclusive use shipment of Low Specific Activity (LSA) radioactive

material, was shipped to an off-site burial facility, and nine of the containers did not meet the criteria for strong tight packages, in that the drain plugs were loose.

This is a Severity Level IV violation (Supplement V).

No response to this item is required based on the prompt corrective action.

PDC Pursuant to the provisions of 10 CFR 2.201, Washington Public Power Supply System is hereby required to 'submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, ATTN:

Document Control Desk, Washington, D.C. 20555, with a copy to the Regional Administrator, Region V, within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include for each violation:

(1) the reason for the violation, if=admitted, -(2) the corrective steps that have been taken and the results

achieved, (3) the corrective steps that will be taken to avoid further violations,and (4) the date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended or revoked,.or why such other action as may be proper should not be taken.

Consideration may be given to extending the response time for good cause shown.
