On December
- 20. 1983, the Commission issued Operating License NPF-21 (five percent power) for the WPPSS Nuclear Project No. 2.
On April 13, 1984, the license was amended to authorize full power (100/) operation.
An operating license fee of $1,024,500 was paid for the issuance of the operating license.
The Comission, under 10 CFR 170, recovers the review costs for the issuance of an operating license.
In this particular instance, the March 23, 1978 fee schedule was in effect at the time the operating license was issued.
Therefore, the maximum fee that can be assessed under that regulation is $1.024,500.
In accordance with Footnote 3 of Section 170.21. the costs incurred in the processing and issuance of the WPPSS Unit 2 operating license have been reviewed and they substantially exceed the maximum fee of $1,024,500 prescribed by the Coiimission's regulations for a custom review under 10 CFR 170.21.A.1.
Since the maximum fee for the operating license has been paid, no additional operating license fee is required for WPPSS Unit 2.
