SUBJECT:

INSPECTION REPORT NO. 50-244/97-13AND NOTICE OF VIOLATION

Dear Mr. Mecredy:

This letter transmits the results of the NRC special inspection conducted on October 27

through November 7 at the Ginna Nuclear Power Station.

The inspection focused on areas

important to the public health and safety, and consisted of an independent evaluation of

motor-operated valve (MOV) program procedures,

calculations, and test results associated

with NRC Generic Letter (GL) 89-10, "Safety-Related Motor-Operated Valve Testing and

Surveillance."

The preliminary findings were discussed

on several instances,

and most

recently on November 18, 1997.

Substantial improvement over the past year was evident. "Self assessment

and

independent reviews were effectively utilized to develop significant enhancements

in MOV

design and testing.

However, the NRC was unable to reach closure regarding the baseline

GL 89-10 program.

While the technical quality of calculations was generally improved,

certain input assumptions were used without adequate validation, resulting in an incorrect

design which under-estimated

the thrust requirements for three MOVs. Design basis

calculations of record (performed by a vendor) had not been finalized under the Ginna

Station Quality Assurance

Plan at the time of this inspection, and had not as such received

formalized RGSE review and approval.

These findings are of concern to the NRC since you

committed in a January 13, 1997 letter to complete the implementation of proposed

enhancements

to the GL 89-10 program in June 1997.

The above findings were characterized

as violations of 10 CFR 50 Appendix B, Criterion III,

"Design Control" and 10 CFR 50 Appendix B, Criterion Vll, "Control of Purchased

Material,

Equipment, and Services."

The violations are cited in the enclosed Notice of Violation

(Notice) and the circumstances

surrounding them are described in detail in the subject

report.

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your response,

you

should document the specific actions taken and any additional actions you plan to prevent

recurrence.

Your response

may reference or include previous docketed correspondence,

if

the correspondence

adequately addresses

the required response.

After reviewing your

response to this Notice, including your proposed corrective actions and the results of

future inspections, the NRC willdetermine whether further NRC enforcement action is

necessar

to ensure compliance with NRC regulatory requirements.
