This refers to your June

7,

1996,

correspondence

in response

to our

Hay 8,

1996, letter, transmitting -Inspection Report 50-244/96-01

and the

Notices of Violation regarding

the

R.

E. Ginna Nuclear

Power Station.

We reviewed your response

in the June

7,

1996, letter regarding the failure to

follow procedures,

which rendered

both power operated relief valves

inoperable.

Thank you for informing us of the corrective

and preventive

actions

documented

in your letter.

These actions will be examined during

a

future inspection of your licensed

program.

In your response,

you also indicated that you disagree

with the second

violation pertaining to the Environmental

Laboratory

and provided your bases.

Our basis for the citation follows.

The nuclear

emergency

response

plan

(NERP) specifically states

that the Environmental

Laboratory "could be used

for diluted post-accident

samples, if needed."

Even though

backup facilities

are not explicitly required

by federal regulations,

the

NERP is the

NRC-

approved

document

(licensing basis for emergency

response)

that contains

the

governing requirements,

which must

be satisfied.

Since you identified this

facility as

an option in the event the primary facility (in-plant laboratory)

was not available, it was considered

in our initial review of your

NERP and

formed

a basis for its approval.

Therefore,

while we recognize

the existence of procedures

for collecting

and

analyzing various environmental

samples,

there

were

no procedures

in place to

utilize the laboratory for the optional

purpose

stated

in the NRC-approved

NERP (i.e.,

as

a radiological laboratory capable of analyzing diluted post-

accident

samples with radioactivity concentrations

far in excess

of samples

normally analyzed

in that laboratory).

As an identified back-up laboratory,

NRC would expect appropriate

procedures

to support that use

and

a

demonstration of the adequacy of those

procedures

during

a drill or exercise.

Post-accident

sampling demonstrations

are usually performed out-of-sequence

(i.e., not at the

same time as the exercise)

and this practice could also

be

used to exercise

the Environmental

Laboratory.
