Dear Dr. Mecredy:
This letter refers to the reactive,
November 21-22,
1994, fitness-for-duty
inspection at the
R.
E. Ginna Nuclear
Power Plant by Mr. E.
B. King of this
office.
The activities inspected
were those authorized
by
NRC License
No.
A discussion of our preliminary findings was held by Mr. King with
you and other members of your staff at the end of the inspection.
The inspection
was conducted
because
of concerns
generated
by ou} in-office
review of your report of a positive drug test in the case of a security shift
supervisor.
Areas
examined in this inspection
are important to public health
and safety,
and are described
in the enclosed
NRC Region I Inspection Report.
The inspection consisted of interviews with personnel
and selective
examinations of procedures
and representative
records.
This inspection
found that, in general,
adequate
programs
were in place for
the detection of drugs
and alcohol in the workplace.
However, it appeared
that random testing for drugs
and alcohol
was not being conducted
in a
statistically random
and unpredictable
manner,
and that all persons
subject to
testing did not have
an equal probability of being tested.
This appears
to
have violated
NRC requirements
as set forth in 10 CFR 26 Section 26.24(a)(2).
An enforcement
conference to discuss this apparent violation is scheduled for
December
20,
1994, at 10:00 a.m.,
in the Region I office.
The decision to
hold
an enforcement
conference
does not mean that the
NRC has determined that
a violation has occurred or that enforcement
action will be taken.
The
purposes
of this conference
are to discuss
the apparent violation, its causes
and safety significance; to provide you the opportunity to point out any
errors in our understanding
of the apparent violation; and to provide
an
opportunity for you to present your proposed corrective actions.
In addition,
the enforcement
conference is an opportunity for you to provide any
information concerning your perspectives
on the severity of the apparent
violation, the application of the factors that the
NRC considers
when it
determines
the
amount of a civil penalty that
may be assessed
in accordance
with Section VI.B.2 of the Enforcement
Policy',
and
any other application of
