rg Me have received copies of the following applications from your company which were filed with the Office of Nuclear Reactor Regulation (ONRR) for review of changes relating to the R. E. Ginna Nuclear Power Plant (Unit Ho. 1) Technical Specifications (TS):
1.
Applications notarized April 9 and October 30, 1980 (transmitted by letters dated April 11 and November 4),
for organizational changes.
2.
Application notarized November 5, 1980 (transmitted by letter dated November 13), for TthI-2 Lessons Learned Category "A" TS changes in.response to OHRR's letter dated July 2, 1980.
With each of the applications in item 1 above, a Class II fee"of $1,200 was remitted, and with item 2, a Class III fee of $4,000 was remitted -.
pursuant to 10 CFR 170.22.
Based on information provided by the OHRR staff as a result of preliminary and/or final reviews of the above applications, it has been determined that:
1.
Your company is entitled to a refund of $1,200 for the April 9 application since no ONRR review had commenced on it when it was subsequently superseded by the applications notarized October 30 and November 5.
The Class II fee paid for the application notarized October 30 is correct, and final review was completed by the OHRR staff on February 10, 1981, as documented by issuance of Amendment No. 35 to License No. DPR-18.

The application notarized November 5 involves consideration of several safety issues; therefore, a Class IV fee of
$1'2,300 is applicable in lieu of the Class III fee of
$4,000 which was paid.
As a result of the above fee determinations, in one instance a refund of
$1,200 is due your company and in the other, the U.S. Nuclear Regulatory Commission is due an additional
$8,300.
Consequently, rather than refund your company
$1,200 for the April 9 application, we are applying it to the
$8,300, and request that your company submit a total of $7,100 to this office to complete the sum due for your November 5 application.
Me hope your company finds this transaction to be an acceptable one.
If the ONRR staff's final review of your November 5 application reveals that the Class IV fee is incorrect, an adjustment will be made.
