Me have received a copy of your application dated August 9. 1982, which was filed with the Office of Nuclear Reactor Regulation (ONRR) for review.
This application requested operation of the R. E. Ginna Nuclear Power Plant at both current and reduced primary system pressure and tempe'rature.
A Class III fee ($4,000) was remitted with your request pursuant to 10 CFR 170.22.
By letter dated September
- 24. 1982. the Rochester Gas and Electric Company withdrew the August 9, 1982 application.
Under the provisions of 'IO CFR 170.12(a),
the USNRC may retain fees for withdrawn applications.
However, the ONRR review staff have informed us that no review of your August 9. 1982 application had commenced when it was withdrawn.
On this basis, we have concluded that an exemption pursuant to 10 CFR 170.11{b) from the fee requirements is hereby authorized by law, and such exemption is otherwise in the pub'lic interest and is hereby granted for this application.
Accordingly,. we are concurrently authorizing the Division of Accounting and Finance to refund $4,000 to your Company.
Refunds are generally processed within a two-week period.
