NOTICE OF VIOLATION Rochester Gas and Electric Company R.

E. Ginna Docket No. 50-244 License No.

DPR-18 During the Nuclear Regulatory Commission (NRC) inspecti6tt" conducted on September 12-16,

1988, violations of NRC requirements were identified.

In accordance with the "General Statement of Policy and Procedure for NRC Enforce-ment Actions,"

10 CFR Part 2, Appendix C (1988),

the violations are listed below:

A.

License Condition E

to facility operating License No. DPR-18, dated December 10,

1984, requires that the licensee fully implement and maintain all provisions of the Commission-approved Physical Security Plan (PSP).

10 CFR 73.55(g)(2) requires that each intrusion alarm be tested for performance at the beginning and end of any period that it is used for security.

If the period of continuous use is longer than seven days, the intrusion alarm shall also be tested at least once every seven (7) days.

Section

3. 1.4 of the Physical, Security Plan, Intrusion Detection Hardware, states that the system has been designed to conform with the criteria delineated in USNRC Regulatory Guide 5.44, dated June
1976, 10 CFR ?3.55(e)(1)(2) and GSA Spec WA-00450B.

This is a Severity Level IV violation (Supplement III).

License Condition E

DPR-18, dated December 10, 1984 requires that the licensee fully implement and maintain all provisions of the Commission-approved Physical Security Plan (PSP).

10 CFR 73.55(c)(1) requires that the licensee locate vital equipment only within a vital area, which in turn, shall be located within a protected area such that access to vital equipment requires passage through at least two physical barriers of sufficient strength.to meet the performance requirements of paragraph (a) of this section.

This is a Severity Level IV violation (Supplement III).

Pursuant to the provisions of 10 CFR 2.201, Rochester Gas and Electric Corporation is hereby required to submit a written statement or explanation to the Nuclear Regulatory Commission, ATTN:

Document Control

Desk, Washington, DC 20555, with a copy to the Regional Administrator, Region I, and a

copy to the NRC Resident Inspector, Ginna within 30 days of the date of the letter transmitting this Notice.

This reply should be clearly marked as a "Reply to a Notice of Violation" and should include [for each violation]:

( 1) admission or denial of the violation, (2) the reason for the violation if admitted, (3) the corrective steps which have been taken and the results

achieved, (4) the corrective steps which will be taken to avoid further violations, and (5) the date when full compliance will be achieved.

Where good cause is shown, consideration will be given to extending the response time If an adequate reply is not received within the time specified in this Notice, an order may be issued to show cause why the license should not be modified, suspended, or revoked or why such other action as may be proper should not be taken.
