The California State Liaison Officer Robert B. Weisenmiller has the following comments regarding the proposed License Amendment: Pacific Gas and Electric Company, Docket Nos. 50-275 and 50-323, Diablo Canyon Nuclear Power Plant, Units 1 and 2 - Emergency Action Level Scheme Change; intended to revise the current EALs to a scheme based on Nuclear Energy Institute (NEI) 99-01, Revision 6, Development of Emergency Action Levels for Non-Passive Reactors, November 2012.

NRC-endorsed Revision 6 of NEI 99-01 is intended to improve the classification of Emergency Action Level (EAL) and the management of nuclear reactor accidents. The standards developed by NEI 99-01 represent an industry effort to improve the management of nuclear emergencies and the new EAL schema implement potential improvements that are real and significant. The California State Liaison Officer supports industry and regulatory efforts to provide more clarity and effectiveness in the management of nuclear emergencies. The Liaison Officer commends NRC staff for their diligence in reviewing the related documents. The NRC staff's diligence was exemplified in the Request for Additional Information (RAI), dated April 12, 2017, which was extensive, covering both procedural and technical elements. These actions represent the appropriate level of effort by NRC staff and the new EAL schemas appear to reflect an improved process. For these reasons, the California State Liaison Officer supports the License Amendment.

Issuance of License Amendment Request for Diablo Canyon Power Plant, Units 1 and 2 -

Emergency Action Level Scheme Change Pacific Gas and Electric Company (PG&E) by letter dated October 25, 2016, as supplemented by letter dated June 21, 2017, submitted a license amendment request to the U.S. Nuclear regulatory Commission (NRC) for approval of the revised emergency plan (E-Plan) and associated emergency action levels (EALs). The amendments revise the current EALs to a scheme based on Nuclear Energy Institute (NEI) 99-01, Revision 6, Development of Emergency Action Levels for Non-Passive Reactors, November 2012. Revision 6 of NEI 99-01 was endorsed by the NRC staff by letter dated March 28, 2013.

The NRC staff is in the process of issuing a license amendment to the Facility operating licenses for Diablo Canyon Power Plant, Units 1 and 2 in next 2-3 weeks. No significant hazards consideration determination was published in the Federal Register on December 6, 2016 (81 FR 87973).

Please let the NRC staff know by August 4, 2017, if State of California has any concerns or comments on the proposed changes to the EAL scheme.
