PERFORMANCE WORK STATEMENT (PWS)

PART 1

1. GENERAL INFORMATION 1.1. Title of Project This is a non-personal services contract to provide the Office of Nuclear Material Safety and Safeguards (NMSS) Agreement States Web site Operations and Maintenance. The contract includes new pages that are intended to be used to communicate information to the Tribes where the sole purpose previously was to communicate information to the Agreement States and the public.

1.2. Introduction NMSS is the program office within the U.S Nuclear Regulatory Commission (NRC) which, in close partnership with other Federal Agencies, Agreement States, non-Agreement States, Native American Tribal governments, the public, and other stakeholders, implements NRCs responsibilities within the broad collective framework of the National Materials Program. The creation of the Office of Federal State Materials and Environmental Management Programs (FSME), which was effective on October 1, 2006, reflected both the changing responsibilities of the NRC and Agreement States as more states became Agreement States, and the need for close coordination and better integration of National Materials Program responsibilities within a single program office increased. FSME merged with NMSS on October 5, 2014.

The current Agreement States Program Assessment Assistance Web site Project, Job Code 6067, is based primarily on the activities of the former Office of State and Tribal Programs. This Statement of Work is for a follow-on agreement to 6067, and will continue to be expanded to cover other activities under NMSS including this current work to add pages to the web site for communications with the Tribes.

A total of 37 states have formal agreements with the NRC, under Section 274 of the Atomic Energy Act of 1954, as amended (AEA), by which those states have assumed regulatory responsibility over byproduct material, source material, and small quantities of special nuclear material. There are approximately 19,100 radioactive material licenses administered by Agreement States, representing about 87 percent of all the radioactive materials licenses issued in the United States.

The NRC is required by the AEA to periodically review the Radiation Control Programs of these Agreement States to ensure that they are compatible with the NRCs rules for the regulation of such materials, and that each states program is adequate to protect public health and safety with respect to the materials covered by the Agreement. NMSS performs approximately ten (10) Agreement State reviews and conducts ten (10)

Agreement State meetings annually. Furthermore, the NRC is authorized and directed, under the AEA, to cooperate with the states in the formulation of standards for protection against hazards of radiation to assure that State and Commission programs will be coordinated and compatible.

NRC provides technical assistance and training to Agreement States and their staff. Technical assistance has ranged from interpreting technical information from license applicants to assisting in state reviews of license

applications and inspections. State radiation control personnel may attend NRC-sponsored courses to improve their ability to maintain high quality regulatory programs.

NMSS collects information on special topics from the states approximately fifteen (15) times a year.

Agreement States voluntarily provide information about their activities through cooperative exchange of information. Agreement States also submit reports on specific activities when requested by NMSS. NMSS is responsible for reviewing all of the above reports and material, and for consolidating the information from the 37 Agreement States into topical reports or other formats that are provided to other NRC offices, the Commission, Congress or the public.

For many years, NMSS has attempted to establish and maintain an easily accessible base of information pertaining to NRCs Agreement States and State Liaison Programs. The concept of the NMSS database included the provision that current information would be available on all desktop computers at the NRC. This objective was achieved with the establishment of the NMSS Homepage. The information was now not only available to the NRC staff but also to the Agreement States and the public. Presently, NMSS has a collection of approximately eighteen (18) years of information that has been loaded onto the current NMSS web site.

This information was captured from Agreement State review letters, questionnaires, Agreement State letters, and other sources, as needed.

In the Commission approved Tribal Policy Implementation Plan, NRC staff outlined activities to support the draft Tribal Policy Statement and changes to the Tribal Liaison program to: (1) Advance communication and understanding between the agency and Tribal governments; (2) Promote timely, consistent and enhanced consultation activities with Tribes; (3) Improve interagency coordination; and (4) Identify the resources to implement changes. The new pages of the web site will support these changes.

1.3. Background The NRC staff relies on using a Web site in communications with the Agreement States, non-Agreement States, and the public on routine program issues, policies, information, and overall Nuclear Regulatory Commission (NRC) policy. This communications support assists the NRC staff in fulfilling its statutorily mandated responsibility under Section 274 of the Atomic Energy Act (AEA) to assure that the States and NRC programs will be coordinated and compatible. The communications support also provides assistance to NRC staff in maintaining an information base and the NMSS Home Page to continue to provide prompt retrieval of Agreement State information. These electronic communications have become an essential part of the NMSS operations. There currently exists a Web site operated and hosted at NRC HQ and maintained by Lockheed Martin. Specifically by design, the Web site is organized into two major sections: a public and a password-protected area. For many years, NMSS has attempted to establish and maintain an easily accessible base of information that relates to NRCs Agreement States and State Liaison Programs. The information was not only available to the NRC staff but also to the Agreement States and the public and, now, the Tribes. Presently, NMSS has a collection of approximately 18 years of information that has been loaded onto the current NMSS Agreement State Web site and is readily available to the Agreement States and stakeholders on the public portion of the Web site. In the password protected section of the Web site resides the SSD Registry that the Agreement States use as a reference to licensing actions and inspections. Also in the secure section of the Web site is pre-decisional information that the NRC provides to the Agreement States that is not available to the public.

The contractor shall provide all personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and other items and non-personal services necessary to perform the NMSS Agreement States

Web site Operations and Maintenance as defined in this PWS, except for those items specified as Government-furnished property and services. The contractor shall perform to the standards in this contract.

1.4. Objective The objective of this project is to assist the NRC in communications with the Agreement States, non-Agreement States, the Tribes, and the public on routine program issues, policies, information, and overall NRC policy. This communications support shall help the NRC in fulfilling its statutorily mandated responsibility under Section 274 of the AEA to assure that the states and NRC programs will be coordinated and compatible.

The communications support shall also include maintaining an information base and the NMSS Homepage in an effort to continue to provide prompt retrieval of Agreement State information. These electronic communications have become an essential part of the NMSS operations.

The objectives for the contractor are as follows:

• Establish the infrastructure to support the new web site pages and implement the new web site pages on the developmental test environment;

• Migrate the data from the existing pages to the new pages on the developmental test environment;

• Migrate the new completed pages from the developmental test environment to the existing web site; and

• Provide System Hosting and Operational Support, Maintenance, and User and Help Desk Support These objectives will support the business practices needed for improved security of radioactive materials.

The contractor shall provide all personnel, materials, hardware, software, supplies, equipment, travel, and other direct costs necessary to accomplish the performance tasks described in Section 1.5.

1.5. Scope of Work This PWS includes development, testing, training, and deployment of the individual web site systems, operational and maintenance support, user support, and hosting of the web site. These tasks cover a broad range of activities including:

• System Infrastructure Setup;

• System Development, Testing, and Deployment;

• System Operational Support;

• Database and application hosting for the systems;

• Maintenance of all infrastructure that is external to the NRC headquarters campus

• Database and application software maintenance; and

• Help desk establishment to provide minimal user support for all systems This PWS is comprised of the following tasks and subtasks:

Tasks Task A Migration of current Web site structure and content Comprised of the Agreement State information Currently, the existing fully functioning web site is built on scripts that use HTML and ColdFusion 9. The search engine used for the databases on the web site, which require login for entry is Verity, is provided with ColdFusion. The databases on the website use ORACLE.

All of the files currently on the web site can be characterized by the following lists of data types:

Public area:

1,023 HTML 41 cfm 4,061 PDF Currently, only one server is being used to host both the secure portion and the public portion of the web site. This will change in the near future such that the public web site will be on one (1) server and the secure server will located on a separate detached server.

The contractor shall either migrate the existing databases to a currently running system or construct a new set of databases on a new system - maintaining all existing functions of the current running systems.

Subtask 1: Create New Tribal Architecture Web Pages Directory Structure from the Existing NMSS SCP Web Site A section on the website must be created as a repository of Agreement State/Radiation Control Programs Director Letters. This section will be identical to the currently existing section on the current web site.

Subtask 2: Create Tribal Toolbox Section A section on the web site must be created as a repository of Agreement State Program Reviews. This section will be identical to the currently existing section on the current web site.

Subtask 3: Create a Resources and Tools Section A section on the web site must be created dedicated to resources and tools.

Subtask 4: Create Communications Section

A section on the web site must be created dedicated to communications to the Tribes.

Subtask 5: Populate the New Architecture with the Tribal Web Pages Information A directory structure framework on the web site must be created the same as it exists on the current web site. This directory structure is organized in such a way that users will be able to easily access all of the NRC Agreement State and Non-Agreement State information stored on the web site.

Subtask 6: Create a Site Map for the Tribal Web Page A site map must be created similar to the existing site map for the NMSS SCP for the new Tribal web site pages.

Subtask 7: Create a Frequently Asked Questions (FAQs) Web Page Section A section on the web site must be created as a Site Map for the NMSS Agreement States Tribal Web Page. This section will be identical to the existing section on the current web site.

Task B Maintenance and Operation of the Information Base for Agreement State Information and Provide for Modification of the NMSS SCP Homepage The NMSS SCP Homepage must continue to offer a read only, on-line, information base accessible to all members of NMSS in the office environment, from remote locations using a suitable notebook computer, or through an Internet connection. The on-line accessible information base shall also be accessible to states, groups or individuals outside of the agency on a read-only downloadable format using Internet or modern access. The product must use the best available database software as discussed in Section 11.

Ideally, information available in the information base can be exported to Word documents with minimal effort. Product shall have a search and hyper-link search capability, and include a report generator for summarizing data available to the users. Data entry would be restricted to designated individuals and/or the contractor supporting the project. Documentation concerning the details and history of the products design and development shall be provided to NMSS.

The contractor will have access to electronic copies of Agreement State reports, letters, and special reports.

The contractor shall be responsible for systems and data maintenance for the NMSS Homepage. This includes hardware/software maintenance, information additions to the existing pages, and data quality control. All quality control procedures shall be documented so that they may be implemented by any subsequent laboratory or contractor. The specific support and maintenance activities to be conducted are listed in Attachment A.

Task C Support Information System Security Certification and Accreditation The contractor shall support the NRC in the development of security-related documentation and any systems analysis required to obtain an Authorization to Operate (ATO) for national security, intelligence, and general information systems that will ensure cradle to grave compliance

including: Federal Information Security Management Act (FISMA); Clinger-Cohen Act; Privacy Act of 1974; Financial Management Integrity Act; Financial Management Improvement Act; Federal Employees Architecture (FEA); Office of Management and Budget (OMB) M-04-04; OMB Circulars A-11, A-123, and A-130; Homeland Security Presidential Directives 7 and 12; National Security Directive 42; Executive Order 13356; Intelligence Reform and Terrorism Prevention Act; Director of Central Intelligence Directives 6-1, 6-3, 6-5, and 8-1; Federal Information Processing Standards (FIPS) 199, 200, and 201; NIST 800 Series; National Strategy for Secure Cyberspace; OMB Information System Security Line of Business; and other applicable OMB and National Institute of Standards and Technology (NIST) series security C&A requirements for classified and unclassified information systems. The specific activities to be conducted are listed in Attachment B.

Applicable Documents to be used as reference when creating documentation to validate compliancy can be located at the following Project Management Methodology (PMM) sites (if access to NRCs internal web site is available, if not, a CD will be provided):

The individual shall be have appropriate expertise to suggest alternatives that may improve service or reduce cost without significant research.

The phrase, Sufficient knowledge of, means the individual(s) has the appropriate knowledge to begin work without the need for significant training or review of the area or work that would otherwise delay the start. The individual(s) may refresh their own knowledge as the work progresses; however, if the work is delayed, then the individuals base knowledge was insufficient.

1.5.1 Contractor personnel assigned to Tasks A, B, and C shall have:

a. A thorough knowledge of, and experience in, the design, development, and maintenance of databases on personal computers that are attached to the local and wide area networks; and

b. Sufficient knowledge of the NRCs rules and policies governing the Agreements States Program, and be able to input data from review, periodic meetings, topical reports and or other documents into a database.

1.5.2 In addition to the qualifications stated in Section 1.5.1 above, contractor personnel assigned to Task B shall have a knowledge of health physics and radiation safety practices associated with the use of byproduct material in medical applications; research; industrial radiography; well-logging; industrial measuring; irradiators; and the transportation and disposal of such material.

1.5.3 In addition to the qualifications stated in Section 1.5.1 above, contractor personnel assigned to Task C shall have:

a. A thorough knowledge of, and experience in, the Information Technology Security areas with respect to local and wide area networks;

b. Sufficient knowledge of the NRCs rules and policies governing Information Technology Security as applied to the Agreement States program; and

c. A thorough knowledge of, and experience in, the information systems security required for the Federal Government (FISMA) and the ability to implement the NRCs Information Systems Security C&A process as defined under PMM.

Note experience in FISMA includes identifying system security vulnerabilities, mitigating the risks to an acceptable level in order to certify and accredit the system, and documenting the controls, which were established.

1.12. Reporting Requirements The contractor shall provide all required deliverables to the NRC PM in accordance with the anticipated schedule below for review and comment. The NRC PM will provide comments to the contractor PM no later than (NLT) the numbers of days specified below. Comments will be provided to the contractor PM by e-mail whenever possible. If adjustments to this schedule are required, the revised dates agreed upon by the NRC PM and contractor PM shall be incorporated into this order via a formal modification to this agreement.

Monthly Letter Status Reports A monthly letter status report (MLSR) shall be submitted to the NRC PM by the 20th of each month following the period reported with copies to the following:
