October 1, 1997 Mr. Thomas F. Plunkett President, Nuclear Division Florida Power and Light Company Post Office Box 14000 Juno Beach, Florida 33408-0420
SUBJECT:
REVISED INCIDENTAL TAKE STATEMENT LIMIT ST.
LUCIE PLANT, UNITS 1 AND 2
Dear Hr. Plunkett:
By letter dated July 7, 1997, Florida Power and Light Company (FPL) provided a
report which described the mortality of two green turtles.
These were the third and fourth green turtle mortalities during calendar year 1997, which exceeds the Incidental Take Statement (ITS) limit inclqded with the National Marine Fisheries Service (NHFS) Biological Opinion dated February 7,
1997.
At
, your request, the NRC reinitiated consultation with NHFS by letter dated July 30, 1997, to amend the ITS limit for green turtles.
The enclosed letter from NMFS, dated August 26,
- 1997, provides the NMFS assessment of your request.
The level of anticipated lethal takes of endangered species and all the terms and conditions of the ITS remain in effect.,
However, the -level of lethal, incidental takes of green turtles for the remainder of calendar year 1997 is changed to authorize an additional two lethal takes.
Therefore, a total of six green turtle lethal takes is authorized for calendar year 1997.
The levels of taking for other species and for green turtles in future reporting years are unchanged.
If you have questions concerning this matter, please, contact me at (301) 415-1495.
Sincerely, Original signed by L. A. Wiens, Senior Project Manager Project Directorate II-3 Division of Reactor Projects-I/II Office of Nuclear Reactor Regulation Docket Nos.
