Docket No. 50-335 Hr. J.

H. Goldberg President Nuclear Division Florida Power and Light Company Post Office Box 14000 Juno

Beach, Florida 33408-0420

Dear Hr. Goldberg:

SUBJECT:

ST.

LUCIE UNIT 1 RELIEF TO ALLOW A NON-CODE TEHPORARY REPAIR OF THE REFUELING WATER TANK (TAC NO. H87217)

As detailed in the attached safety evaluation, the staff has determined that Code repair requirements in this case are impractical, as defined under the provisions of 10 CFR 50.55a(g)(6)(i),

and that granting of the requested relief is authorized by law and will not endanger life or property or the common defense or security and is otherwise in the public interest, given due consideration to the burden upon the licensee and facility that could result if the Code requirements were imposed on the facility.

Therefore, pursuant to 10 CFR 50.55a(g)(6)(i), relief is granted until the next scheduled refueling outage for the St. Lucie Unit 1 facility, upon which the leaking portion of the RWT is required to be repaired or replaced in accordance with the appropriate provisions of the ASHE Code,Section XI.

Sincerely, (Original Signed By)

Herbert N. Berkow, Director Project Directorate II-2 Division of Reactor Projects I/II Office of Nuclear Reactor Regulation ib
