In your response

to Violation A(1), you stated that you did not agree that the

requirement for minimum volume of liquid in waste

was not met

and that tests

conducted

by South Carolina

Department of Health

and

Environmental

Control,

FPL and

Chem Nuclear indicated that the criteria for minimum volume of liquid

(O.M) had

been

met.

The regulations

specify that in no case

shall liquid

exceed

0.5% of the volume of the waste for waste

processed

to

a stable

form.

Liquid is not defined by the regulations

as water but may be any physical state

characterized

by the free

movement of material.

As verified by your

own

guality Assurance

audit,

one liner in the

shipment

in question failed to

solidify, as

evidenced

by

a paste-like

material

flowing from the liner when

punctured,

while the

second

contained

a

mass

equal

to approximately

85K

solidification.

It is the

NRC position that the requirement for 0.5% minimum

volume of liquid means that 99.5X of the volume of the waste will be solid.

In

the

case of your liners,

one was free flowing when punctured

and the other was

only 85% solidified.

Therefore,

the criteria for minimum volume of liquid in

your shipment

was not met and the violation is considered

correct

as stated.
