Dear Mr. Kreitchman:

Thompson DNottingham Grace This is in response to your letter to the Nuclear Regulatory Commission (Commission) dated July 13, 1983 concerning gualification Report gR 52600-515.

In your letter you requested that this report be treated as proprietary and withheld from public disclosure as provided in 10 CFR 2.790(b).

Your letter to the Commission was prompted by a letter that you received from Bechtel Power Corporation (BPC) acting on behalf of Florida Power and Light Company (FP&L) concerning documents related to the Commission review of St. Lucie Plant, Unit No. l.

The BPC letter was initiated as a result of a request from FPBL and was based upon a request made by the Commission in a letter that, was sent to FPSL on April 21, 1983.

The Commission's letter (copy enclosed),

among other things, specifically asked the licensee to "inform us as indicated in the proprietary review section of the Safety Evaluation whether any portions of the identified pages still require proprietary protection."

It was further requested that this information be supplied within thirty days.

The Commission, under the provisions of 10 CFR 2.790, requires more than a simple request to withhold a document from public disclosure.

In meeting its obligation under 10 CFR 2.790 the Commission relies on the licensee to provide the information necessary to make its determination.

Your request, along with those of other vendors affected by the Commission

request, should have been transmitted to us by the licensee.

FPSL, with the necessary justification called for in 10 CFR 2.790.

Since this is not the first request on this docket, we have referred your letter to the licensee to initiate the appropriate action to comply with our request of April 21, 1983 and to provide the information required under the provisions of 10 CFR 2.790.
