50-'335/389 Based on our review, we conclude that with FPSL's implementation prior to May 1, 1982 of a NRC approved sea turtle nest surveillance and relocation program (FPSL has yet to submit their program),

the environmental impacts v associated with building and operating the third intake, considered both individually and cumulatively, are not different from and will not be signifi-cantly greater than those described and evaluated in our earlier environmental impact statements on St. Lucie in connection with the existing two intake structures.

In view of your expressed need to begin construction immediately, there is no objection to proceeding with construction.

We must advise, however, that based on concerns over the increased losses of sea turtles related to Unit 2 operation it is possible that FP&L will be asked to consider taking further steps to reduce sea turtle mortalities.

These steps may include engineered features to exclude turtles from the intakes.

Until consultation required. under the Endangered Species Act is

complete, any work on the new intake structure should be done in recognition that modification of the intake structure may be necessary prior to operation of St. Lucie Unit 2.

We expect to resolve this issue with the appropriate federal agencies within sixty days.
