Me have received a copy of your application dated October 3li, 1980, which v(as filed with the Office of Huclear Reactor Regulation (ONRR) for review.
This application proposed certain Technical Specification changes for St. Lucie Unit No.
1 as requested by OHRR's letter dated July 2, 1980, on TNI-2 Lessons Learned Category "A" items.
Fees pursuant to 10 CFR 170.22 were not remitted with the application since the July 2 letter stated that licensing action.
associated with the Lessons Learned activities would be exempt from, fees.
- However, by letter dated August 7, 1980 (copy enclosed),
ONRR advised all operating, power reactor licensees that the exemption stated in the July 2 letter was.not justified, and that licensees should include fees pursuant to 10 CFR 170.22 for responses to the July 2 letter.
Therefore, licensees who have not paid fees are being requested to do so.
Based on information provided by the ONRR staff as a result of a fee analysis of your application, it has been determined that this application involved consideration of a safety issue.
On this basis, a Class III fee of $4,000 is appropriate.
Although the ONRR staff completed their review of this applica-tion on January 19.
1981 (as reflected by the issuance of Amendment Ho. 37 to License DPR-67), this fee determination is considered an interim determination.
It is considered interim because an overall review of the fee class or classes for applications re'lating to TNI-2 Lessons Learned Specifications is being done within the Office of Nuclear Reactor Regulation.
If this review revea)s that the Class III is not correct, your Company will be notified and an adjustment will be made.
In the meantime, a total of $4.000 is required for the October 31'pplication and should be remitted to our office.
