NOTICE OF DEVIATION Commonwealth Edison Company Dresden Station, Units 2 and 3 Docket Nos.

50-237; 50-249 license Nos. DPR-19; DPR-25 During an NRC inspection conducted on February 4 through March 15, 1993, a deviation of a commitment to maintain the torus area radiation monitors operable was identified.

In accordance with the "General Statement of Policy and Procedures for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the deviation is listed below.

Summary Report, "Compliance to Regulatory Guide 1.97," was submitted by licensee letter J. Wojnarowki, CECo, to D. Crutchfield, NRC, dated August 1, 1985.

In that report, the licensee committed to use the torus area radiation detectors for the primary containment area radiation monitors specified in Regulatory Guide 1.97, Revision 3, "Instrumentation for Light-Water-Cooled Nuclear Power Plants to Assess Plant Conditions During and Following an Accident."

The NRC concluded in letter M. Grotenhuis, NRC, to L. Butterfield, CECo, dated August 31, 1987, that the licensee provided an explicit commit1T1ent on. conformance to Regulatory Gui de 1. 97.

Contrary to the above, since January 1989, the torus area radiation monitors have. been inoperable.

Document Control Desk, Washington, 0.C. 20555, with a copy to the Regional Administrator, Region III, and a copy to the Dresden NRC Resident Inspector, in writing within 30 days of the date of this Notice, the ~easons for the deviation, the corrective steps which have been taken and the results achieved, the corrective steps which will be taken to avoid further deviations, and the date when your corrective action will be completed.

Where good cause is shown, consideration will be given to extending the response time.
