Dear Mr. Osborne:
By your application dated May 20, 1999, and your affidavit dated May 20 1999, you submitted, "Allegheny Electric Cooperative, Inc. Decommissioning Status Report For Unit 1 and Unit 2 of the Susquehanna Steam Electric Station," and requested that it be withheld from public disclosure pursuant to and in accordance with Title 10 of the Code of Federal
~Re ulations (10 CFR) Section 2.790. A non-proprietary version was submitted for placement in the Nuclear Regulatory Commission (NRC) public document room.
The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:
The Allegheny Electric Cooperative, Inc. (ALC), Decommissioning Status Report contains confidential financial and commercial information that should be withheld under 10 CFR 2.790(a).

This information has been held in confidence by ALC. To the extent that ALC has shared this information with others, it has done so on a confidential basis.
There is a rational basis for holding this information in confidence The ALC Decommissioning Status Report contains financial and other commercially sensitive information which requires protection in connection with ALC's commercial position in the competitive electric utilityindustry.
This information is customarily held in confidence by ALC in order to protect its competitive position in the marketplace.

This information is being transmitted and received in confidence.
It is not available from public sources and could not be gathered readily from other publicly available information.

Public disclosure of this information would cause substantial harm to the competitive position of ALC, because such information could be used by others to harm it and thereby gain a competitive advantage over it.

Osborne We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.790 and, on the basis of your statements determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, the versions of the submitted information marked as proprietary will be withheld from public disclosure pursuant to 10 CFR 2.790(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding information from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents.
If the need arises, we may send copies of the information to our consultants working in this area.
We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
lf the basis for withholding this information from public inspection should change in the future, such that the information could then be made available for public inspection, you should promptly notify the NRC. You should also understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you willbe notified in advance of any public disclosure.
