21.21 (a)(2) INTERIM EVAL OF DEVIATION INTERIM REPORT CONCERNING SUPPLY OF STAINLESS STEEL TUBING The following is a summary of a report received via fax:

"This [interim report is being provided] in accordance with 10 CFR Part 21.21 concerning the supply of 0.5 inch Stainless Steel Tubing to the Duke/Progress Energy Brunswick Nuclear Generating Station. Mackson Nuclear subcontracted Tioga Pipe to supply the tubing. Tioga Pipe in-turn subcontracted Summerill Tube; in which Summerill Tube procured the tubing commercially utilizing the provisions of ASME Section Ill, NCA 3855.5.

However, Summerill failed to properly implement the requirements of NCA-3855.5(a)(2) in that a product analysis of each piece of unqualified source material was not performed.

"Tioga Pipe does not have the capabilities to conduct an evaluation of the defect to determine if a substantial safety hazard exists in the tubing supplied to Duke/Progress Energy. As such, Tioga cannot provide a timeframe as to an expected completion date, and is relying on the licensee, Duke/Progress Entergy, to make the final determination.

This letter provides an interim report in accordance with §21.21 concerning the supply of V2" Stainless Steel Tubing to the Duke/ Progress Energy Brunswick Nuclear Generating Station. Mackson Nuclear subcontracted Tioga Pipe to supply the tubing. Tioga Pipe in-turn subcontracted Summerill Tube; in which Summerill Tube procured the tubing commercially utilizing the provisions of ASME Section III, NCA 3855.5. However, Summerill failed to properly 'implement the requirements of NCA-3855.S(a)(2) in that a product analysis of each piece of unqualified source material was not performed. Please see Attachment 1, "Interim Report Notificatio.n Information per §21.21", for additional details and clarification.

IV. Nature of the defect or failure to comply and the safety hazard which is created or could be created by such defect or failure to comply.

Summerill Tube Corp purchased unqualified source material from Shanghai Maxmount Special Steel Co. Ltd and failed to properly certify in accordance with ASME Section III NCA-3855.S(a)(2) in that Summerill subcontracted only 1 product analysis per Heat/ Lot for the unqualified source material instead of the required 1 product analysis per piece of source material (4 analyses should have been performed). The material was drawn into 48 pieces to supply Tioga Sales Order 878586 and directly shipped to Brunswick 1 & 2 on January 11, 2017.

Summerill Tube Corp notified Tioga Pipe on April 28, 2017 Tioga Pipe notified Mackson Nuclear on May 5, 2017 Mackson Nuclear notified Duke/ Progress Energy on May 8, 2017 VI. In the case of a basic component which contains a defect or fails to comply, the number and location of these components in use at, supplied for, being supplied for, o:r may be supplied for, manufactured, or being manufactured for o:ne or more facilities or activities subject to the regulations in this part.

( 48) 20 ft long pieces =960 total linear feet supplied to Brunswick 1 & 2. On May 1Qth Brunswick advised Mackson & Tioga that approximately 30 feet had been installed.

VII. The corrective action, which has been, is being, or will be taken; the name of the individual or organization responsible for the action; and the nength of time that has been or will be taken to complete the action.

Tioga Pipe Corrective Action, N-CAR-2017-20 has been generated.

Completed Actions:

1. Extent of condition: Tioga Quality performed an extent of condition, from January 2014 to Present of all Tioga Pipe Sales Orders with Summerill Tube. No additional Sales Orders were affected by this noncompliance. (Exception Action #2)

2. Summerill Tube identified in an email to Tioga Pipe on May 4th that that 2 additional Tioga Sales Orders were affected by the improper certification. Sales Orders 904897-1 (0.375" OD X 0.035" MW SA213 316TP /316L Tubing) and 904897-2 (0.375" OD X 0.049" MW SA213 ~

316TP /316L Tubing); Tioga located this material in its inventory

.which was immediately quarantined and tagged with NC tags. NCRs, N-NCR-2017D07 and N-NCR-2017-08 were raised with a disposition of "reject"/ "scrap".

3. Notified Mackson Nuclear of Part 21 reportable condition for~"

316TP/316L tubing supplied to Duke/ Progress Energy.

6. Evaluate Summerill Tube's qualification status and determine if supplemental audit required for dedication of commercial material, and control of purchased items and services - due May 28, 2017
