Dear Mr. Halligan:
Pursuant to your telephone call of January 22, 1981, I am sending you an additional copy of the two documents you requested:
"NRC Staff Response Supporting in Part and Opposing in Part Applicants'otion for Partial Summary Disposition of Contention 17" and the NRC Staff letter of January 14, 1981, advising the Licensing Board of the Staff's receipt of an application for a special nuclear material license foe new'uel.
I trust that these copies will be more legible than.earlier copies received by you which you found illegible.
You further..-requested that we provide to you transcripts from earlier prehearing conferences.
On December 3, 1980, the Comptroller General of the United States wrote a letter to the NRC Chairman indicating that the NRC cannot lawfully'use appropr iated funds from fiscal year 1981 to implement its procedural cost reduction program.
One of the components of this program was the provision of transcripts to intervenors (non-applicant parties).
On December 4, 1980, Chairman Ahearne directed the NRC Staff to stop transmitting documents previously available under the procedural assistance.
Thus, the Staff is unable to comply with your request.
I would
- note, however, that copies of all transcripts (as we11 as other documents) are available for inspection and copying in the Commission's local document room in the Osterhout Free Library in l<ilkes-Barre and in the Pennsylvania State University Library in University Park.
