REQUEST FOR WITHHOLDING INFORMATION FROM PUBLIC DISCLOSURE FOR MCGUIRE NUCLEAR STATION, UNIT 1 (CAC NO. MF9344)
Dear Mr. Capps:
By letter dated March 13, 2017 (Agencywide Documents Access and Management System (ADAMS) Accession No. ML17080A169}, you submitted an affidavit dated March 2, 2017, executed by Gayle Elliot, Deputy Director, Licensing and Regulatory Affairs for AREVA, Inc.,
requesting that the information contained in the following document be withheld from public disclosure pursuant to Title 10 of the Code of Federal Regulations (10 CFR}, Part 2, Section 2.390:
AREVA Document, 02-926828348D-001, "McGuire Unit 2 Safety Injection Line Full Structural Weld Overlay Implementation Drawing" AREVA Document 08-9268347-000, "McGuire Unit 2 Cold Leg 'D' Safety Injection Line Elbow Overlay" AREVA Document 51-9268389-000, "McGuire Unit 2 Safety Injection Line Elbow Weld Overlay Fracture Mechanics Evaluation" AREVA Document 32-9268383-000, "McGuire Unit 2 Cold Leg Injection Piping Loads for Weld Overlay" AREVA Document 32-9268474-000, "McGuire Unit 2 Cold Leg Safety Injection Line Elbow FSWOL Sizing Calculation" The affidavit stated that the submitted information should be considered exempt from mandatory public disclosure for the following reasons:

These Documents contain information of a proprietary and confidential nature and is of the type customarily held in confidence by AREA VA and not made available to the public. Based on my experience, I am aware that other companies regard information of the kind contained in these Documents as proprietary and confidential.

These Documents have been made available to the U.S. Nuclear Regulatory Commission in confidence with the request that the information in these Documents with withheld from public disclosure. The request for withholding of proprietary information is made in accordance with 10 CFR 2.390. The
information for which withholding from disclosure is request qualifies under 10 CFR 2.390(a)(4) "Trade secrets and commercial or financial information."

(e) The information is vital to a competitive advantage held by AREVA, would be helpful to competitors to AREVA, and would like cause substantial harm to the competitive position of AREVA We have reviewed your application and the material in accordance with the requirements of 10 CFR 2.390 and, on the basis of the statements in the affidavit, have determined that the submitted information sought to be withheld contains proprietary commercial information and should be withheld from public disclosure.
Therefore, AREVA Documents 02-926828348D-001, 08-9268347-000, 51-9268389-000, 32-9268383-000, and 32-9268474-000, marked as proprietary, will be withheld from public disclosure pursuant to 10 CFR 2.390(b)(5) and Section 103(b) of the Atomic Energy Act of 1954, as amended.
Withholding from public inspection shall not affect the right, if any, of persons properly and directly concerned to inspect the documents. If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, ensure that the consultants have signed the appropriate agreements for handling proprietary information.
If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the Nuclear Regulatory Commission (NRC). You also should understand that the NRC may have cause to review this determination in the future, for example, if the scope of a Freedom of Information Act request includes your information. In all review situations, if the NRC makes a determination adverse to the above, you will be notified in advance of any public disclosure.
