SUBJECT:

SUBMISSION OF CHANGES TO STATE/LOCAL EMERGENCY PLANS This letter responds to an issue raised by a member of your staff.

On December 21,

1993, David Sokolsky spoke with Gai 1 Good regarding the existence of a regulatory requirement to submit changes to State/local emergency plans and procedures.

During the conversation Mr. Sokolsky referred to a June 13, 1983, letter to PGKE (Philip A. Crane, Jr.)

from LeRoy Norderhaug which indicated that changes to State/local emergency plans and procedures were r equired to be submitted by 10 CFR 50.34(b)(6)(v).

A copy of this letter is attached.

If you have any questions regarding this matter, please contact Ms.

Good at (510) 975-0240.

Sincerely, After further review of the applicable regulations

[10 CFR 50.34(b)(6)(v),

50.33(g),

and 50.54(s)(l)]

and discussion with the Emergency Preparedness

Branch, Nuclear Reactor Regulation (NRR),

we concluded that there is no requirement for utilities to submit changes to State/local emergency response plans.

Ms.

Good notified Mr. Sokolsky of this position on January 11, 1994.

I understand that Ms.

Good stated that further submissions would not be

. necessary as of that date.
