Gentlemen:

The Commission's regulations note that "the public interest may be served through settlement. of particular issues in a proceeding or the entire pro-ceeding" and for that reason state that "the fair and reasonable settlement of. contested fnitfal lfcensfng. proceedings fs encouraged."

To-further this goal, the regulations also state that "It fs expected that...

all of the parties to those proceedings will take appropriate steps to carry out this purpose.'bid.

This letter fs to suggest such a procedure fn the Diablo Canyon proceeding.

The Atmfc Safety and Licensing Board's recent October 2, 1980 Order Relative to PGAE's Notion for Low Power Testfng requires that 'contentions relative to fuel loading and low-power testfng should be. filed by October 27, 1980."

In view of the Licensing Board's Order and fn-furtherance of the spirit of the. cited regulations, ft would be desfrable to meet'and define and(or refine any of the contentions which mfght be admissible fn the low power testing proceeding.

The purpose. of such a meeting would be to (1) obtain agreement concernfng some or al'1 of the issues involved; (2) develop appro-priate stfpulatfons of fact; (3) dfscuss proposed. schedules; and (4} discuss the possibility of'ett)ement of-sane or all of. the remaining issues before ~

the Licensing Board.

The HRC Staff suggests that counsel for the parties to this proceeding convene in Bethesda the week of november 3, 1980 to discuss the above matters.
