JOINT AFFIDAVIT OF ROBERT L.
ROTHMAN AND PAO-TSIN KUO Robert L. Rothman and Pao-Tsin Kuo, being of legal age and duly sworn, depose and say as follows:
1.
Pao-Tsin Kuo, a structural
- engineer, is employed by the Office of Nuclear Reactor Regulation, U. S. Nuclear Regulatory Commission.
Dr. Pao-Tsin Kuo testified at the seismic hearings in the above captioned case.
A copy of Dr. Kuo's professional qualifications is bound into the transcript following TR. 8697.
Robert L. Rothman, a seismologist, is employed by the Office of Nuclear Reactor Regulation, U. S. Nuclear Regulatory Commission.
A copy of Dr. Rothman's professional qualifications is attached to this affidavit.
Dr.
Kuo s contribution to this. affidavit is with respect to structural engineering matters and the DCNPP design response spectra and Dr. Rothman's contribution is with respect to seismological matters raised by Joint Intervenors.
I 2.
The purpose of this affidavit is to point out an error in our previous affidavit which was submitted as part of the NRC Staff Response to Joint Intervenors'otion to Reopen.
3.
Horizontal Res onse S ectra/Newmark Res onse S ectra In the previous affidavit it was stated that:
"Only two horizontal response spectra (Station 5 and Bonds Corner Station) out of twenty slightly exceed the Newmark horizontal design spectrum in the frequency range of interest (2-33 cps)..."
A reexamination of the spectra sub-sequent to the submission of the affidavit revealed the fact that one of the horizontal spectra (El Centro Array Station 8, 230')
had been misplotted.
The scale on the computer plot for this component was mislabeled.
The replot of this spectrum (see attachment) shows that it slightly exceeds the Newmark horizontal design spectrum in the neighborhood of 5 cps.
4.
Since the change involved is insignificant, we are still of the opinion that the data from the Imperial Valley Earthquake does not provide evidence that would invalidate the Newmark design response spectra for the Diablo Canyon Nuclear Power Plant.

Enclosed is a self-explanatory letter from my constituent, Mrs. Robert, H. Leddy, concerning the Diablo Canyon Nuclear Power Plant in California.
As you will note, Mrs. Leddy is greatly concerned that this plant is near a major earthquake fault.
She feels that this is unsafe as the plant i's not built to withstand major earthquakes.
Any information you may be able, to provide regarding this matter will be appreciated.

P I am taking the time to write this note because the safety of nuclear power is so critical to the health of our nation.
It is now several days after the Hosgri fault earthquake.
In the absence of any'greed upon data regarding the seismic safety of the Diablo Canyon nuclear plant, it seems prudent to reopen the seismic hearings before granting a license to
'opexate 'the'plant.
It is well known that the 'plant was not designed to bear the force of an earthquake the magnitude the Hosgri fault is probably capable of creating.
Licensing the plant to operate seems foolhardy at this point ~

The earthquake which struck the Central California coast where Diablo Canyon Nuclear Power Plant is located is ample indication that local faults are alive and active.
To license for'operation a nuclear facility under such circumstances is not only foolhardy, but would indicate complete disregard for the wishes
- and, indeed, the safety of residents of San Luis Obispo County.
\\Ye rely on you to refuse the license.

Zf the Nuclear Regulatory Commission wishes to resain credibility for the Nuclear Industry and our government a
to have this industry continue as a viable source of energy, Diablo Canyon must never be licensed for testing.
To grant
~ permission for testing would seal the fate of the nuclear industry and herald its end for certain.
Diablo Canyon's siting, was a mistake in judgment.
This error was compounded by deception in covering up the Hosgri. fault.
This error of judgment must be corrected before irreparable damage is done.

The whimsies of nature are at work and intelligent conscientious men who reject the public be damned attitude must decide that they cannot gamble with nuclear energy with these harzardous odds stacked against them.
By your own recommended criteri.a, nuclear reactors should not be sited nearer than twelve and one-half miles from an earth-quake fault, which really doesn't mean a thing, but to consider granting' license for testing for Diablo, practically on an earthquake fault with the geological upheaval rampant on the u~'!

s Come to your senses e If you wish to salvage your nuclear industry and salvage the Ameri.can people on the VestcGoaht, deny the license for Diablo Canyon.
