ROTHMAN AND PAO TSIN KUO SUPPLEMENTAL STAFF AFFIDAVIT INTRODUCTION On May 5, 1980, the NRC Staff filed its response to the Motion of San Luis Obispo Mothers for Peace, Scenic Shoreline Preservation Conference, Inc.,

Ecology Action Club, Sandra Silver, Gordon Silver, Elizabeth Apfelberg, John J. Forster (Joint Intervenors) to reopen the record.

In their motion the Joint Intervenors seek to have the Appeal Board receive new information with respect to the seismic contentions raised in this proceeding and with respect to environmental qualification and aging of safety related equipment.

As discussed herein and in the attached Joint Affidavit of Robert L. Rothman and Pao-Tsin Kuo (Rothman and Kuo Affidavit) (May 19, 1980), the Staff seeks to revise its May 5 response.

DISCUSSION The Joint Affidavit of Robert L. Rothman and Pao-Tsin Kuo, dated May 5, 1980 and attached to the Staff's response, contains the statement:

"Only two horizontal response spectra (Station 5 and Bonds Corner Station out of twenty slightly exceed the Newmark horizontal design spectrum in the frequency range of interest (2-33 cps),

as shown in the attachment."

As stated in the attached Rothman and Kuo Affidavit, the horizontal response spectrum for the El Centro Array Station 8, 230'lso slightly exceeds the Newmark horizontal design spectrum in the neighborhood of 5 cps.

The response spectra for the El Centro Array Station 8, 230'the ninth document in the series of response spectra attached to the Joint Affidavit of Rothman and Kuo dated May 5, 1980) was misplotted by the Staff due to the mislabeling of the scale on the computer plot for this component.

This was not known at the time of the Staff response on May 5, 1980.

The change involved is insignificant (Rothman and Luo Affidavit of May 19, 1980 at 2); it does not invalidate the Newmark design response spectra for the Diablo Canyon Nuclear Power Plant.

Accordingly, the position of the NRC Staff set forth in the "NRC Staff Response to Joint Intervenors'otion to Reopen" (dated May 5, 1980) is not changed.

However, in order to assure that the information being considered by the Appeal Board is

correct, the attached Joint Affidavit of Robert L. Rothman and Pao-Tsin Luo should be accepted as a revision to the previously filed Joint Affidavit of Robert L. Rothman and Pao-Tsin Kuo, dated May 5, 1980.

CONCLUSION For the foregoing reasons, the NRC Staff requests that the Appeal Board accept the Joint Affidavit of Robert L. Rothman and Pao-Tsin Kuo, dated May 19,

1980, as a revision to the "NRC Staff Response to Joint Intervenors'otion to Reopen,"

dated May 5, 1980.
