I am pleased to respond to your NovemIber 8, 1979 referral of a letter to the Chairman from your const1tuent mrs. H. R. House.

Since rulings and de'cisions related to the Diablo Canyon Nuclear Power Plant could be subject to review by the Corimission, it would not be appropriate for the Cormissioners to comment on your constituent' concerns regarding Diablo Canyon at this time.

Therefore, your letter was referred to me for reply.

Your constituent inquired as to whether a study, similar to the one performIed for the Rancho Seco Nuclear Power Plant, by the General Accounting Office (GAO), had been conducted to determine the "danger zone" for Diablo Canyon; and if it has, ho>I far does the danger zone extend from the Diablo Canyon Plantf The GAO has not prepared a study regarding emergency preparedness for the Diablo Canyon Plants.

However,'with one exception, the conclusions and recommendations of the Nuclear Regulatory Commission (NRC) generally agree with those in the GAO report regarding nuclear plant emergency preparedness that will b'e appli.ed to all nuclear power plants including Diablo Canyon.

Specifically the GAO recommendations in.their report that an emergency p'tanning zone extending 10 miles from nuclear power plants be established, agreed with the findings of an NRC-EPA Task Force Report NUREG-0396 dated December 1978.

The NUREG-0396 report recommended 10 and 50 mile planning zones which have been endorsed by the Nuclear Regulatory Comoission.

The Diablo Canyon Emergency Response Plan, which is currently being reviewed by the NRC staff, will contain appropriate actions to accommodate both the '10 and 50 mile emergency zones.*

In addition, a Nuclear Power Plant Emergency Review Panel, appointed by Governor Brown, )Ias conducted studies to improve the emergency response capabilities in the event of a nuclear accident in the State of California.

The Pacific Gas 5 Electric Company stated that it was actively work1ng with Governor Broom' Panel.

In regard to your constituent's cogent on the storage of radioactive waste, a notice of a proposed rulemQking on this matter was published in the Federal Register on October 25, 1979.

The purpose of the proposed rulemaking is to reassess the Co>mission' degree of confidence that radioactive wastes produced by nuclear facilities will be safely disposed of, to determine when such disposal will be available, and whether such wastes can be safely stored until they are safely disposed of.
