In view of the above considerations, there will be unavoidable delays on plants close to completion such a4 Diablo Canyon.

However, the Cotm>ission is proceeding on the Action Plan on the highest priority 4asis in order to minimize these delays.

Although our primary responsibility is with the health and safety of the public from the plant, operation, we also recognize the need to proceed with licensing in a responsible manner to provide needed additional safe electrical power generating capacity to your area as soon as possible.

Yore I am pleased to respond to your letter of November 3, 1979 to the President which was referred to me for reply.

In your letter, you urged that an operating license be issued f'r the Diablo Canyon Nuc'lear Pover Plant.

The President, in response to the recommendations of the President's Comllission on the accident at the Three Nile Island fhclear Poser Plant, requested the Nuclear Regulatory Cormission (NRC) to resolve the various issues to permit reslNlption of licensing actions no later than dune 1980.

Toward this objective, the NRC is preparing an Action Plan which is scheduled to be presented to the Comlission in mid-February and, if approved, will be for warded to the affected utilftses promptly thereafter.

The Action Plan will delineate the specific issues that must be resolved, the detailed criteria for implementation, and the various implementation deadlines.

However, the Atomic Safety and Licensing Board assigned to the Diablo Canyon public hearings may require further public hearings on public contentions related to the Action Plan requirements.

Dear Nr. Tuiddy:

I Your letter to President Carter -regarding nuclear power has been forwarded to this office for consideration.

in recognition of the severe implications of our continued dependence on foreign oil, President Carter has offered a t<ational Energy Plan that calls f'r a combination of energy sources to meet our electrical requirements.

He has also stressed the importance of conserving energy by such practices as driving our cars less and lowering the heat in our homes.

Under the Energy Plan, solar, geothermal and fusion technologies are receiving great emphasis and accelerated development.

However, their status is such that even under the most successful of efforts they vill not'be able to meet all of the addi-tional energy needs of the United States during the remainder of this century.

Thus, in the near and intermediate term, coal and uranium must provide an increasing share of electrical generation.

The important pole that nuclear power must play in our energy future has been expressed repeatedly by the President and the Secretary of Energy.

The solution of the energy problems of this Nation will require the full support of an informed public and your efforts in this regard are greatly appreciated.

I am writing this letter because I am concerned about the critical energy shortage looming in our country.

I am sure you:.'re fully aware that adequate energy supplies are essential to a healthy economy, and without such supplies increased unemployment and economic hardships are inevitable.

The problem in our country is that a number of critical energy projects have been delayed because large segments of government regulations (including Federal and state) as presently practiced is leading to a state of chronic indecision and paralysis.

In energy matters absence of decision means absence of energy.

President'Carter, we in California know you as a fighter, and I am asking for your. help to 'force government (Federal and State) to pursue a policy to reduce our dependence on foreign oil,through a balanced program of electric energy development.

I am asking for you to speak out and force the goverment to do all'possible to expedite the energy projects determined as necessary to meet our future electric

demands, and especially the critical Diablo Canyon 'Nuclear power plant which is essent-ially complete and ready to operate safely.

4I I find no reason why the licensing process for the Diablo Nuclear plant cannot go forward.

. This plant has been subjected to the most intensive safety evaluation ever, and may be the most throughly studied project known to man, 1
