PETITION SUBMITTED PURSUANT TO 10 CFR 2.206 BY BEN L. RIDINGS (TAC NO.

M84890)

Enclosed is a copy of a petition, "Petition for Emergency Enforcement Action and Request for Public Hearing," dated October 27,

1992, submitted pursuant to 10 CFR 2.206 by Ben L. Ridings.

The petition requested the Commission to take direct review of it.

The Commission has declined to take direct review and has referred the petition to the Director of the Office of Nuclear Reactor Regulation for a decision under 10 CFR 2.206.

The petition requests the NRC to immediately order Niagara Mohawk Power Corporation (NMPC) to cease power operation of Nine Mile Point Nuclear Station Unit No.

1 (NMP-1) and place the reactor in a cold shutdown condition.

The petition also requests the Commission to provide for a public hearing prior to authorizing resumption of plant operation.

Relief is sought based on allegations that:

(1)

NMPC is operating NMP-1 in violation of the requirements for availability of an Emergency Core Cooling System (ECCS) grade high pressure core injection (HPCI) system and (2) 45% of the containment isolation valves have administrative deficiencies.

As part of the petitioner's concern regarding the availability of a HPCI system, the petitioner stated that the feedwater

system, which can operate in a HPCI mode, is not an acceptable alternate since it is not provided with a backup electrical power supply provided by an onsite emergency diesel generator, The petitioner's second concern regarding use of the feedwater system in a HPCI mode is that some 44 out of 47 valves in the feedwater injection flow path are not included in the NHP-1 Inservice Test Program for pumps and valves.

The petitioner also alleges that NMPC and the NRC were notified of these alleged problems in January 1990 and that no action has been taken.

NMPC is requested to review the enclosed petition and provide us with NMPC's views regarding this petition within 30 days of the date of this letter.
