Dear Mr. Sylvia:

On March 18, 1991, the U.S. Department of Labor's Wage and Hour Division in Syracuse, New York, received a complaint from a former employee of Niagara Mohawk Power Corporation (NMPC).

The former employee

alleged, in part, that he was a victim of discrimination and retaliation because he had raised safety concerns while performing'is duties at Nine Mile Point.

On October 11, 1991, NRC was informed by the U.S. Department of Labor that a negotiated.

agreement had been reached between the two parties.

While a settlement has been reached in this case, the NRC is interested in determining what action was taken against this employee and the reasons for such action.

Therefore, please provide the basis for the employment action regarding the former employee and include a copy of any investigation reports regarding the circumstances of the action.

Further, please describe the actions, taken or planned, to assure that this employment action willnot be misunderstood by NMPC employees and does not have a chilling effect in discouraging other licensee or contractor employees from raising perceived safety concerns.

You are requested to provide this information to our office within 30 days of the date of this letter.

Please indicate in your response whether any of the information that you provide should be withheld from public disclosure based on the provisions of 10 CFR 2.790(a).

Please cite the specific provision of this regulation that is applicable or other basis for non-disclosure.

In accordance with 10 CFR 2.790 of the NRC's "Rules of Practice," a copy of this letter will be placed in the NRC Public Document Room.

The responses directed by this letter are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, Pub. L. No.96-511.
