Notice of Violation (NRC Inspection Report No. 50-410/91-17)

This refers

to the inspections

conducted

on June

23,

1991

through July 27, 1991,

and

July 28,

199-1 through September 7, 1991, at Nine Mile-Point Unit 2, Scriba, New York, and

to the apparent

violations identified in NRC Inspection

Report No. 50-410/91-17,

dated

October 8, 1991

~ On October 17, 1991, you and members ofyour staff attended an enforcement

conference at the Region I office to discuss two apparent violations, which were identified by

your staff.

One involved inoperability of the standby

gas treatment

system

and the other

involved a loss of configuration control on a secondary containment unit cooler.

We agree with your analysis as presented

at the enforcement conference that the inoperability

'f

the affected unit cooler did not make the standby

gas treatment

system

inoperable

and

therefore, no violation of Technical Specification Limiting Conditions for Operation occurred.

However, we are concerned

that the unit cooler became

inoperable

as

a result of loss of

configuration control resulting from a lack of procedural compliance.

The NRC is particularly

concerned

about this in light of past configuration control problems at this site.

Based on the

discussions during the enforcement conference and further review, we have determined that one

violation ofNRC requirements occurred, as described in enclosed Notice of Violation. The loss

of configuration control is being cited as a Level IV violation, in accordance with the "General

Statement of Policy and Procedures

for NRC Enforcement Action," 10 CFR 2, Appendix C

(1991).

You are required to respond to this letter and should follow the instructions specified in the

enclosed Notice of Violation (Notice) when preparing your response.

We acknowledge your

stated commitment to revise Licensee Event Report (LER) No. 50-410/91-16 to provide the

results of your recent analysis and assessment

of the safety significance and root cause of the

uncontrolled isolation of the secondary containment unit cooler, and you may refer to this LER

in your response,

where applicable.

In your response,

you should document the specific actions

taken and any additional actions you plan to prevent recurrence.

After reviewing your response

to this Notice, including your proposed corrective actions and the results of future inspections,

the NRC will determine

whether further NRC enforcement

action is necessary

to ensure

compliance with NRC regulatory requirements.
