Nine Mile Point Unit 2 Restart Authorization and Closeout of Confirmatory Action Letter 91-13 This letter releases Niagara Mohawk Power Corporation for restart of Nine Mile Point Unit 2.

Further, this letter acknowledges completion ofcommitted actions as described in Confirmatory Action Letter (CAL) 91-13, dated August 15, 1991.

As described in your letters dated September 10, 1991, to me and September 10 and 11, 1991, to S. Varga, you have concluded that you understand the root causes of the August 13, 1991 Site Area Emergency event and have implemented corrective actions, as needed, to support a safe restart and return to power operation for Nine MilePoint Unit 2. Your assessment included the physical readiness of the plant, including short-term corrective actions for the equipment deficiencies identified; operational and organizational readiness, based on corrective actions to plant operating and station emergency procedures; and, implementation of new training based on lessons learned from this event.

As discussed with you in the NRC Restart Readiness Assessment Team exit meeting on September 16, 1991, the NRC has completed its review ofyour corrective actions resulting from the August 13, 1991 Site Area Emergency event and your satisfaction of commitments documented in CAL 91-013.

You are reminded that you committed to maintain all records associated with this event and subsequent investigations for a period of at least two years.

The Office of Nuclear Reactor Regulation also reviewed your determination of the root cause and corrective actions for the UPS failures and related issues.

This assessment is attached as Enclosure

1. A summary of the NRC Restart Readiness Assessment Team's inspection findings is provided in Enclosure 2 to this letter.

A detailed inspection report will be issued under separate correspondence.

Niagara Mohawk Power Corporation We understand that, although all short-term corrective actions have been completed, some issues regarding long-term analysis, equipment upgrades and emergency plan changes are not yet complete.

We expect your continued commitment to implement these long-term corrective actions.

Finally, based on our review of the steps you have taken to identify and correct problems associated with this event, both in material condition and in administrative controls, we agree that Nine Mile Point Unit 2 is ready for restart.
