Subject:
NOTICE OF VIOLATION This is to inform the Commission that the staff intends to exercise broad discretion and not propose a civil penalty for a Severity Level III violation at Nine Mile Point Unit 1.
Prior notice to the Commission is required before exercising this authority in accordance with Section V.G of the Enforcement Policy.
The violation involved failure to do prior reviews pursuant to 10 CFR 50.59, when in July of 1981, the function of the Radwaste Processing Building (RPB) was changed from that stated in the FSAR to a temporary liquid radioactive waste storage area and later in October 1981, to a long-term radioactive liquid waste storage area.
Notwithstanding the limited safety significance of the actual
- changes, the failure to perform the required prior reviews resulted in contamination beyond that originally expected, the potential for added worker contanmination and the potential for unanalyzied release of radioactivity to the environment.
Application of the normal guidance in the Enforcement Policy is not warranted and a civil penalty is not proposed because of the age of the violation and the major management changes that have been made during the extended shutdown because of the licensee's past inability to identify and correct problems.
It should be noted that the licensee has not been specifically informed of the enforcement action.
