PROPOSED INPOSITION OF CIVIL PENALTY - $ 100,000 Thfs fs to inform the Commission that a Notice of Vfolatfon.andpPjiposed Imposition of Civil Penalty fn the amount of One Hundred Thousand-Dollars
($ 100,000) will be issued on or about March 14, 1988 to Niagara Mohawk Power Corporatfon.
This action fs based on operation of the plant. between+Dune 1986 and September 1987 without dfspositfonfng certain weld flaW;indications which were identified by the inservice inspections conducted durfng the 1986 refueling outage.
The licensee failed to take advantage of subsequent opportunities to identify and correct these deficiencies.
In addition, the appropriate operations personnel were not notified when the existence of these nonconformances was identified.
The base cfvfl penalty was increased by 100 percent because of the licensee's prior poor performance fn the area of concern.
It should be noted that the licensee has not been specifically informed of the enforcement action.
The schedule of issuance and notification fs:
Mailing of Notice Telephone Notification of Licensee The State of New York will be notified.
March 14, 1988 March 14, 1988 The licensee has thirty days from the date of the Notice fn which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
